In accordance with Article 10 of the Personal Data Protection Law No. 6698 (“PDPCT”), we would like to inform and enlighten you regarding your personal data provided to us during the process of providing health services by Torak Dental Oral and Dental Health Services Limited Company and its personnel. We emphasize that we show utmost sensitivity in protecting the confidentiality and security of all your personal data, and all necessary technical and administrative security measures have been taken to ensure the protection of this data.
DATA CONTROLLER AND REPRESENTATIVE
In accordance with the law, Torak Dental Oral and Dental Health Services Limited Company, operating at the address “Yenibosna Merkez Mahallesi Eski Edirne Yolu Caddesi D Blok No: 51/D Bahçelievler - Istanbul” (hereinafter referred to as "Radar Dental Clinic"), is the data controller.
PERSONAL DATA COLLECTED BY THE CLINIC
- Identity Information (Your name, surname, Turkish ID number, place and date of birth, marital status, gender, insurance number, and other identity data that may identify you)
 - Contact Information (Your address, phone number, email address, and other contact details)
 - Financial Data (Bank account number, IBAN, credit card information, billing information, etc.)
 - Health Information (Your blood type, examination data, diagnosis and operation details, medical history, family medical history, laboratory results, medical imaging results, examination appointment details, prescription information, medications you are using, before-and-after operation photos, vaccination and HES code information, anamnesis data, pre-examination consultation, diagnosis, treatment, and follow-up process discussions and written communication with your doctor via digital platforms like email, SMS, WhatsApp, social media, digital messaging platforms, etc.)
 - Closed-Circuit Camera System Footage recorded during your visit to our clinic
 - Medical documents you have provided voluntarily, anamnesis form data
 - Website browsing information, IP address, browser information, and form data
 
PURPOSE OF PROCESSING PERSONAL DATA
Your personal data is processed based on your explicit consent and/or other processing conditions specified in Article 5/2 of the PDPCT. Considering the services provided by Radar Dental Clinic, your personal data will be processed for the following purposes:
- To fulfill the requirements related to the services we provide and ensure that the individuals benefit from the services provided in the scope of service delivery
 - To fulfill our legal obligations as set forth in laws such as the Health Services Fundamental Law No. 3359, the Decree-Law on the Organization and Duties of the Ministry of Health and its affiliated institutions, the Regulation on Private Healthcare Institutions Providing Outpatient Diagnosis and Treatment, the Regulation on Processing Personal Health Data and Ensuring Privacy, and other relevant regulations
 - To protect public health, preventive healthcare, medical diagnosis, treatment, and care services, and to plan and manage health services and their financing
 - To respond to any questions and complaints you may have regarding the health services you received
 - To measure, improve, and research patient satisfaction
 - To issue billing for the services provided
 - To inform you about new or complementary services available
 - If you make an appointment, to notify you about the relevant appointment details
 - To comply with legal reporting and information-sharing obligations when requested by public institutions and authorities as required by applicable regulations
 - To comply with the legal obligation to retain information and documents
 - Based on your explicit consent, for educational and awareness purposes for the public, promotion, volume increase, scientific research, and training
 - And for any other purposes in accordance with the conditions and purposes for processing personal data set forth in Articles 5 and 6 of Law No. 6698
 
METHOD OF COLLECTING PERSONAL DATA AND LEGAL BASIS
Your personal data will be collected through various means (whether oral, written, or electronic), including physical documents (such as contracts, printed forms), or in electronic environments such as the company's website, email, internal software, call center voice recording systems, etc.
Your personal data may be processed without your explicit consent when any of the following legal conditions are met:
- Processing is required due to the legal obligations under the laws and regulations in effect in the Republic of Turkey (such as the Turkish Civil Code, Commercial Code, Labor Law, Health Services Fundamental Law No. 3359, the Decree-Law on the Organization and Duties of the Ministry of Health, the Regulation on Processing Personal Health Data, etc.)
 - When it is necessary to process your data for the protection of your life or physical integrity, and you are unable to give consent due to physical impossibility
 - When it is necessary to process the data for the performance of a contract between you and us
 - When processing your personal data is required to fulfill our legal obligations
 - When your personal data has been made public by you
 - When processing is required for the establishment or protection of our legal rights
 - When processing is necessary for our legitimate interests, provided that your fundamental rights and freedoms are not impaired
 
Your special categories of personal data (health data, sexual life data) are processed and stored based on the following lawful grounds:
- Your explicit consent
 - For special categories of personal data other than health and sexual life, processing may occur without your explicit consent when legally required
 - Your health and sexual life-related personal data may be processed without your explicit consent for the purposes of protecting public health, preventive healthcare, and the provision of medical diagnosis, treatment, and care services, the planning and management of healthcare services and their financing by Radar Dental Clinic
 
PARTIES TO WHOM PERSONAL DATA IS TRANSFERRED AND PURPOSE OF TRANSFER
Your personal data may be shared with the Ministry of Health, its subunits, the Social Security Institution, private insurance companies, law enforcement, judicial authorities, authorized representatives, lawyers, tax and financial advisors, auditors, third-party service providers that we cooperate with, regulatory and supervisory institutions, healthcare institutions both domestic and abroad that we cooperate with for medical diagnosis and treatment, ambulance, medical equipment, and health services providers, and other data processors as stipulated in Articles 8 and 9 of Law No. 6698.
Your personal data will be kept confidential and protected as a professional secret under the Personal Data Protection Law and will not be shared with third parties, except in cases required by law.
RIGHTS OF THE DATA SUBJECT
As a data subject, you have the following rights under Article 11 of the Law:
- To learn whether your personal data has been processed
 - To request information regarding the processing of your personal data
 - To learn the purpose of processing your personal data and whether it is used in accordance with that purpose
 - To know the third parties to whom your personal data has been transferred within the country or abroad
 - To request correction of personal data that is inaccurate or incomplete
 - To request the deletion or destruction of your personal data
 - To request that the correction, deletion, or destruction of your personal data be communicated to third parties to whom the data has been transferred
 - To object to the occurrence of a result that is unfavorable to you due to the analysis of your personal data solely through automated systems
 - To request compensation for damages caused by the unlawful processing of your personal data
 
As per Article 4 of the Personal Data Protection Law No. 6698, your personal data must be accurate and, if necessary, up to date. Therefore, in the event of any changes to your personal data, please notify us of your updated and accurate personal information using the methods below.
